Do you require planning permission for a summer house?

- No more than 3 metres high (if it has a pent roof)
- Not within 2 metres of a boundary (if over 2.5 metres high)
- No more than 4 metres high (if it has an apex roof)
- Neither in front of your home or closer to public highway than your house
If the size, shape, and placement exceed these restrictions, then you’ll have to apply for planning permission from your local authority. You’ll also need to get permission if your summer house has a floor space of 15-30 square metres or more, or if you intend to use the building for commercial purposes. Can I live in a summer house?
Though its name implies that it’s a house, which people normally do live in, it’s actually illegal to live in a summer house full-time – unless you have planning permission. Of course, you can have a visitor stay the night and sleep in your summer house every now and then, but if you intend to use it as a regular living facility then you must apply for the appropriate permissions first.
For a shed or garden summer house to become a safe place to sleep in every night, you must convert it to comply with building regulations. This isn’t the same thing as planning permission, meaning that you need to consider both. These regulations cover health and safety concerns like structural stability, insulation, ventilation, electricity, water supply and drainage, and fireproofing.
You must adhere to the rules closely, and the finished conversion must pass an inspection before you’re allowed to start using the summer house as self-contained accommodation. Remember that planning permissions are about where you construct it, while building regulations are about how you construct it. Don’t forget that when a summer house becomes an extra liveable room, this can affect your council tax band.
